Mediation in Colorado is a process of negotiation in which a neutral third party, the mediator, assists the parties with negotiating an agreement which addresses the issues required to be resolved by the Colorado courts in order for the court to approve a divorce decree and/or parenting plan. Mediation is a confidential process in the sense that all communications related to mediation are not shared with anyone, including the court, unless an agreement is written down and signed by all parties. This allows both parties to speak freely with the mediator regarding their positions, which can lead to a more open discussion and hopefully a more honest agreement. If those positions do not become a written and signed agreement of the parties, those discussions/positions cannot be used against either party later in court. A mediator can inform the court that mediation took place if the court required the parties to attend mediation.
